Drone rules in Germany (2026): registration, zones, fines

In short

You can fly a drone in Germany under the EU rules, usually in the open category: under 25 kg, in visual line of sight and within 120 m of the ground. Register with the Federal Aviation Office (LBA) if your drone weighs 250 g or more, can transfer more than 80 J on impact, or has a camera and is not a toy, and hold liability insurance, because German law treats drones as aircraft. Before every flight check the dipul Map Tool, since § 21h LuftVO restricts flying near airports, over homes, over nature reserves and Natura 2000 areas, near federal trunk roads, federal waterways, railways and many other sites.

Who regulates drones

Drones in Germany are regulated by the Luftfahrt-Bundesamt (LBA, Federal Aviation Office), which runs the pilot exams, issues the certificates and keeps the register of drone operators. Its drone department in Braunschweig answers at uas@lba.de.1,2,3

  • The aviation authority of the federal state (Landesluftfahrtbehörde) supervises open-category flights, grants most authorisations in the specific category and permits flights in geographical zones. The rest of the specific category, such as declarations for standard scenarios, lies with the LBA.1,2,4

Registration

Residents of Germany register as operators with the LBA if they fly a drone of 250 g or more, or one that can transfer more than 80 J on impact, or a lighter one with a camera or other sensor that can collect personal data unless it is a toy. Every drone in the specific category needs registration too.2,4

  • Register before your first flight, online and in German only, with a scan of your identity document and your insurance policy number. You can be registered in only one EU member state at a time.2,5,6,4
  • The LBA sends you one e-ID that covers all your drones. Display it on every drone you operate.2,6,4
  • Registration costs EUR 20 for natural persons and EUR 50 for legal persons, charged once.7,8

Categories and weight classes

Most hobby flights fall into the open category, which needs no prior authorisation. The drone must weigh under 25 kg, stay in visual line of sight within 120 m of the closest point of the ground, never fly over assemblies of people and drop nothing.4

  • In A1, C0 and eligible legacy or privately built drones under 250 g may overfly uninvolved people but never assemblies. C1 must be flown with the reasonable expectation that no uninvolved person will be overflown. A2 keeps 30 m from uninvolved people, reducible to 5 m with active low-speed mode under the applicable conditions. A3 stays 150 m from residential, commercial, industrial and recreational areas.4
  • The class label decides the subcategory: C0 (under 250 g) and C1 (under 80 J on impact or under 900 g) fly in A1, C2 (under 4 kg) in A2 or A3, C3 and C4 (under 25 kg) in A3. C1, C2 and C3 drones must fly with active remote identification and geo-awareness.9,4
  • Drones without a class label placed on the market before 1 January 2024 fly in A1 if under 250 g and in A3 if under 25 kg. Anything outside the open category needs an authorisation, or for a standard scenario a declaration, from the authority where the operator is registered.4

Pilot competence

The pilot test depends on the class, not only the weight: a C1 drone, and any flight in A3, needs online training and an online theory test of 40 questions with a 75% pass mark. In Germany it runs on the LBA platform, in German only, and costs EUR 25.4,10,7

  • Flying in A2 also needs the A2 certificate: self-practical training and an extra theory exam of at least 30 questions, taken at a testing centre designated by the LBA with a valid identity document. The LBA charges EUR 30 to issue the certificate; the testing centre's exam fee is not part of it.4,1,11,7
  • The minimum pilot age is 16, which dipul confirms for Germany, except for C0 toys in A1, privately built drones under 250 g and flights under direct supervision of a qualified pilot. The online test result and the A2 certificate are valid for 5 years.4,12
  • Carry your proof of competency while flying, unless the drone is a C0 or an unlabelled or privately built drone under 250 g.4

Where you can fly

Keep the drone in visual line of sight, watch for manned aircraft and stop the flight if it becomes a risk. At night the drone must show a green flashing light.4

  • German airspace is free for drones unless the law restricts it, and § 21h LuftVO sets geographical zones where flying is allowed only under conditions. These rules apply even where a zone has not been published on a map.1
  • Within 1,000 m of an airport boundary, or within 1,000 m of its runway centrelines extended by 5 km, you may fly only in the specific category. Inside a control zone you need an air traffic control clearance.1
  • Prohibited and restricted areas also apply: a restricted area may be entered only as far as its terms allow or with a clearance. dipul lists the current temporary restrictions, which can also be published by NOTAM.1,13

Geographical zones

Within 1.5 km of aerodromes that are not airports you need the specific category or the consent of the aviation supervision office, flight control or aerodrome operator. A 100 m buffer, where you need explicit consent, surrounds industrial plants, prisons, military sites, central power generation and distribution plants, constitutional bodies and supreme or higher federal and state authorities, diplomatic sites, police properties and hospitals.1

  • Within 100 m of federal trunk roads, federal waterways and railways you need consent, or your height must stay below your horizontal distance with more than 10 m of distance at all times. Swimming pools and bathing beaches may be overflown only outside opening or bathing hours.1
  • Over nature reserves, national parks and Natura 2000 areas (Habitats Directive sites and bird protection areas) you need the nature authority's consent unless state law says otherwise. Accident and emergency sites, within 100 m, need the consent of the head of operations.1,14
  • The dipul Map Tool shows the zones as far as possible, but not accident and deployment sites. In justified cases the state aviation authority can permit a flight in a zone and may ask for the landowner's consent or an expert report.15,16,1

Insurance

German law treats model aircraft and non-leisure drones as aircraft, and every keeper of an aircraft must hold liability insurance. dipul states that this applies to all drone operators.2,12

  • The minimum cover follows § 37 LuftVG: 750,000 units of account (IMF Special Drawing Rights) for aircraft under 500 kg.17,2
  • Carry the insurance certificate while flying. An existing private liability policy may already cover drones, so check the wording with your insurer.17,12

Privacy and photos

Over residential property you may fly only with the owner's or occupant's explicit consent, with a drone of up to 0.25 kg that can neither record nor transmit images, sound or third parties' radio signals, or at 100 m or higher under strict conditions.1

  • The 100 m option needs a legitimate purpose that no public or non-residential land can serve, owner consent that cannot reasonably be obtained, and protection of the residents' privacy, usually with advance notice. The flight must not be expected to exceed the TA Lärm noise limits and may not take place between 22:00 and 6:00 local time.1
  • Privacy and data protection are part of the online pilot test, and a zone permit is granted only if the flight does not breach data protection rules.4,1

Flying as a visitor

If you are registered as an operator in another EU member state, such as Czechia, Poland, Spain or France, you do not register again, and EU remote pilot certificates are recognised in Germany.4,18,19

  • Liability insurance is compulsory for drones in Germany, so check that your policy covers flights here and carry the certificate. For foreign aircraft it must show the maximum weight, sum insured and period of cover, be in German, English, French or Spanish, and come from an insurer authorised to do business in Germany.2,12,17
  • Visitors from outside the EU and EASA states register with the authority of the first EU country where they fly when registration is required, with the LBA if that is Germany. A non-EU drone qualification does not replace the EU competence required for your operation. Complete the EU training and examination when your drone class and subcategory require them; the obligation is not universal for every lightweight drone.9,20,1,4
  • EU residents register in their home country, not in Germany, and the German online test is in German only, so it is easiest to take the test at home before the trip.4,10

Penalties

Flying in a § 21h zone without meeting its conditions, or breaking a condition of a zone permit, can be fined up to EUR 50,000.1,2

  • Operators resident in Germany who fly without registering first, any operator whose drone does not carry its registration number, and listed breaches of the EU drone rules, such as the 120 m height limit or the A1, A2 or A3 conditions, face the same cap.2,4
  • These caps are for intentional breaches; negligence can be fined up to EUR 25,000. Breaching the rules of a prohibited or restricted area is a crime, punishable by up to two years in prison.2,21

Do I need insurance to fly a drone in Germany?

Do I need to register a drone under 250 g in Germany?

Only if it can transfer more than 80 J on impact, or has a camera or another sensor that can collect personal data and is not a toy. Registration with the LBA costs EUR 20 for private persons, and the e-ID goes on every drone you fly.2,4,7,6

Can I fly my drone over houses and gardens in Germany?

Where can I check drone no-fly zones in Germany?

Use the official dipul Map Tool. It cannot show accident and deployment sites, and the § 21h rules apply even where a zone is not on the map.15,16,1

I live in Czechia, Poland, Spain or France. Can I fly my drone in Germany?

Yes. Your operator registration and EU pilot certificates from home are valid in Germany, but you need liability insurance that covers flights here, with a certificate in German, English, French or Spanish, and must follow the German zones.4,18,19,2,12,17,1

What are the fines for drone offences in Germany?

Zone violations, flying without insurance, flying unregistered as a German resident or without the registration number displayed, and listed breaches of the EU drone rules can each be fined up to EUR 50,000, or up to EUR 25,000 if negligent. Breaching the rules of a restricted area is a crime.1,2,4,21
